ATHOL — An appeal brought to the Zoning Board of Appeals last month resulting in the board taking an informal straw vote to waive its jurisdiction was formally dismissed at Wednesday’s board meeting. The petitioners, Darlene and Johanna Lawlor-Moore of 3449 Chestnut Hill Ave., are seeking an administrative appeal of the Athol Planning Board’s Site Plan Review decision of a solar farm located at 3824 Chestnut Hill Ave., in the Residential Commercial Zoning District. The appeal had gone to land court first instead of the board, and the judge sent a letter to the board requesting it give the court jurisdiction to handle it.

The board also approved of a modification to a Special Permit request by Brian Hunton of Hart Family Properties, Rutland, Mass., for a Commercial/Professional business located at 392 South Main St., Athol in the Residential Commercial Zoning District. Hunton would like to build out a third business office, requiring a modification of the previous permit approved for two businesses.
